§ 25-12.1. Selling, soliciting, etc. from occupants of motor vehicles or pedestrians.

  • (a)

    The following words, terms, and phrases, when used in this section, shall have the meaning ascribed to them in this subsection, except where the content clearly indicates otherwise.

    Person means any natural person, or any firm, corporation, association, group, club, society or other organization.

    Public right-of-way means the traveled portion of dedicated streets, roads, or alleys including medians, from curb to curb, within the corporate limits of the city.

    Charitable shall include patriotic, philanthropic, social service, benevolent, educational, religious, cultural, medical or fraternal purposes.

    (b)

    Sale, Advertisement, Distribution or Solicitation of Assistance, Employment, Goods, and/or Services on Public Right-of-Way Prohibited: It shall be unlawful for any person to stop, stand, sit, walk upon or occupy any public right-of-way for the purpose of promoting, advertising, selling, distributing, or soliciting financial assistance, employment, transportation, donations, money, goods, or any other services to or from occupants of motor vehicles or pedestrians, for private use or benefit, commercial gain, or any charitable purpose. This prohibition shall not apply to public right-of-way temporarily closed by order of the Owensboro Police Department in conjunction with any government sponsored event or approved community festival or activity.

    (c)

    Obstruction of Public Sidewalk Prohibited: No person(s) shall congregate upon, place any property or direct any improvements that encroach on, any public sidewalk, in such manner as to obstruct same or inhibit the free flow of pedestrian traffic.

    (d)

    Penalties: Any person violating any provision of this article, shall upon conviction thereof, be punished by a fine not to exceed two hundred fifty dollars ($250.00), or by imprisonment for a term not to exceed ninety (90) days, or both. Each day (a twenty-four-hour period) on which a violation occurs or continues, shall constitute a separate offense under this section.
